With the Regulation Amending the Regulation on Distance Contracts (“Regulation”) published in the Official Gazette dated August 10, 2024, numbered 32628, the expressions “1/1/2025” in the first and second paragraphs of the provisional article 1 of the Regulation on Distance Contracts have been changed to “1/1/2026”.With this amendment, the limitations on the goods and services for which the right of withdrawal can be exercised and the provisions regarding the costs of returns to be borne by the consumer under the contract, which were planned to come into force on January 1, 2025, have been postponed for one year and will now come into effect on January 1, 2026. Consumers will continue to exercise their right of withdrawal (return) without providing any reason or paying any penalty until January 1, 2026.
The contracts where consumers will not be able to exercise the right of withdrawal as of January 1, 2026, are as follows: contracts related to movable properties that are required to be registered under the Highways Traffic Law No. 2918, contracts related to unmanned aerial vehicles that require registration or certification, contracts related to mobile phones, smartwatches, tablets, and computers that have been delivered to the consumer, contracts entered into by open auction in the form of a live auction, and contracts related to goods for which installation or assembly is stated to be carried out by the seller or authorized service in the instruction manual and where such installation or assembly has been performed.
The provisions of the first paragraphs of the provisional article 1 of the Regulation on Distance Contracts, as they stood before being amended by the Regulation Amending the Regulation on Distance Contracts published in the Official Gazette dated August 23, 2022, numbered 31932, will continue to be applied until January 1, 2026, and the relevant links to these amendments can be accessed below.
